Terms and Conditions
1. TOTAL PRIZE POOL VALUE including tank, freight, installation and land application area is $15,000. 2.The Promoter is True Water Solutions Pty Ltd of Chatsworth Island NSW, ABN 72 134 910 875. 3. The competition commences on Wednesday the 1st of June, 2011, and concludes Friday the 18th of November, 2011. 4. The community giveaway is open to entries from registered charity groups, non-profit organisations or community groups which are situated within the following Council shires: Tweed, Lismore, Ballina, Casino, Kyogle, Byron, Clarence, Richmond, Coffs Harbour and Nambucca. 5. Application forms can be submitted via post to True Water Solutions, PO Box 2004, Chatsworth Island, 2469. 6. Judging will take place at the True Water Solutions offices on Friday the 26th of November, 2011. 7. The winner will be announced on Friday the 26th of November 2011, at a presentation at the True Water Solutions offices. 8. Fuji Clean systems require four services a year which will be completed by True Water Solutions. The first year servicing will be provided free of charge, servicing thereafter will be at the winners cost. 9. The entries will be judged on the community group's need for a treatment system and their service to the community. 10. Final system installation is subject to and conditional upon Council approval. 11. In participating, the winners agree to participate and cooperate as required in all editorial activities relating to the giveaway, including but not limited to being interviewed and photographed. 12. True Water Solutions as the promoter offers No Liability. 13.1 Nothing in these terms and conditions limit, exclude or modify or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or the Competition and Consumers Act including the statutory consumer guarantees under Australian consumer law or similar laws in the States and Territories of Australia. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the promoter excludes all liability (including negligence), for any personal injury; or any loss of damage; whether direct, indirect, special or consequential, arising in any way out of the promotion. 13.2 The Promoter (including its officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case the liability is limited to the minimum allowable by law), Including the Non-Excludable Guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the promoter. 13.3 True Water Solutions Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited too consequential loss) or claim that may occur. 13.3.1 during the draw. 13.3.2 whilst undertaking any travel connected with entry unto the draw; 13.3.3 in the participation of any prize; 13.3.4 as a consequence of late, lost, or misdirected mail; 13.3.5 due to circumstances outside the promoter's reasonable control. 14. The promoter's decision is final and the promoter will not enter into correspondence regarding the result. 15.1 In the event that any prize is unavailable, the promoter reserves the right to substitute a prize item of equal or lesser value. Any taxes (other than GST) or ancillary costs which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner. 15.2 If for any reason the winner does not take the prize or any element of the prizes at the time stipulated by the promoter, then that prize will be forfeited.
